Conflicting conditions of the purchaser, in particular the purchaser’s own terms and conditions of purchase, which are almost always geared to the purchase of general items, shall not be recognized by us, even if they are designated as solely authoritative. By placing orders, the purchaser accepts our terms and conditions of purchase as solely binding. Any deviating agreements, including those made with our representatives, shall only be valid if they have been confirmed by us in writing. 2. Offers Unless otherwise agreed, our offers are subject to change until the final order confirmation; errors and misprints excepted. Furthermore, we reserve the right to deliver equivalent products instead of the articles shown in the catalogue, unless instead of the items shown in the catalogue, unless otherwise expressly stipulated in the order. 3. Prices All prices are in Euro without value added tax. The agreed prices are basic prices. They are fixed prices if there are no significant increases in the price of raw materials by the date of delivery. Significant increases shall be deemed to have occurred if the prices for raw materials increase by more than 2%. 4. Delivery time All information given by us in offers, confirmations, etc. regarding the delivery time is given to the best of our judgement. They are only to be regarded as approximate and are non-binding for us in every way. The delivery period shall commence on the date of our order confirmation. It will be adhered to as far as possible; however, any delays do not entitle the purchaser to withdraw from the contract or to claim compensation for damages. 5. Force majeure Operational disruptions of any kind, whether caused by lack of machinery, goods, raw materials or fuel, by work stoppage for any reason, war, export and import bans, fire, disruption or blocking of transport routes, as well as any other cases of force majeure, shall release us from compliance with any promised delivery times and from the obligation to complete delivery, without the customer being entitled in this case to withdraw from the contract. Force majeure shall be deemed to include circumstances which make delivery substantially more difficult or impossible for us, regardless of whether they occur at our premises or those of our subcontractors. 6. Deliveries Deliveries are made ex works or ex warehouse, for the account and at the risk of the purchaser. The order value should be at least 50,00 €, otherwise an additional 10,00 € handling fee will be charged. 7. Calculation For the calculation the day of the dispatch readiness is valid, without consideration whether by goods blockage or other circumstances delivery, dispatch or collection cannot take place. When payment is received, the oldest justified claim will automatically be charged. 8. Dispatch If no specific instructions are given in the order, the shipment will be made to the best of our ability, without any responsibility for the cheapest shipping or good arrival of the goods. In case of shipment with parcel services or CEP service providers, their specifications are binding. As a guideline, the girth is valid. It is calculated as follows: 2x height + 2x width + 1x longest side of the package (e.g.: package dimensions H x W x L: 0.30 x 0.20 x 2.0 m = belt dimension: 2x 0.30 + 2x 0.20 + 2.0 m = 3.0 m). As a rule, the belt dimension may be max. 3.0 m. In case of shipment with forwarding agencies, long goods surcharges are usually incurred for a package length of 1.60 m or more. These depend on the respective forwarding agent and will be invoiced by us accordingly. From a net order value of 1,000.00 € the BWG Bauteam Profi Produkte GmbH takes over these costs. In the case of agreed franco delivery additional freight charges, which arise due to the special nature of the goods, shall in any case be borne by the customer. The goods are to be checked for completeness and damage immediately upon receipt. Defects are to be reported to the carrier immediately. A later claim will not be accepted. Our company does not accept any transport damages. In the case of express goods and express deliveries within 24 hours, the shipping costs shall be borne by the customer. 9. Transfer of risk The risk is transferred to the customer as soon as the goods leave our warehouse or are made available to the customer. We shall not be liable for any damage or loss suffered by the goods during transport, even if carriage paid delivery has been agreed.
